O H & S Compliance When Selling Used Agricultural Machinery
PLANT/EQUIPMENT AND AUCTION GOODS SAFETY ADVICE TO ALL PURCHASERSThe occupational health and safety (plant) regulations 1995 and equipment (public safety) general regulations 1995 requires the following information to be supplied to buyers if it is applicable.
Important notice. All motorized, electrical or mechanical plant and equipment must be tested, inspected or dismantled sufficiently to consider any hazards which may be unknown. The occupational health and safety act and regulations and codes of practice require the buyers, employer and all operators of the items purchased to exercise duty of care in the supply or the use and all safe operation of plant and equipment, general goods and all other perishable items. Accordingly, before these items are used domestically or commercially, supplied or consumed, or used at any site once removed from the auction site, they must be fully operational, safe and/or fit for consumption. The purchases warrant that it is their responsibility to ensure the above. The Vendor warrants that the plant and equipment is offered free of any financial encumbrance. There may be no maintenance records for any plant or equipment sold. Owner’s manuals for plant and equipment (if any) will be available to the purchaser.
