Clearing Sale Terms and Conditions
A buyer’s premium may apply to the knockdown price of all goods sold at some Clearing Sales (This will be advertised at the coomencement of that particular Clearing Sale and will be noted in all advertising).
Photo ID is required and number system applies.
All goods MUST be paid for in cash, cheque or EFTPOS (when available) and removed from the property by 5.00 pm on the day of sale, unless otherwise arranged with the Auctioneer.
It is the buyer’s responsibility to check all goods prior to purchase. No responsibility is expressed or implied by the Vendor or the Auctioneer as to the condition of goods sold at any Clearing Sale
If goods are left on the property after 4.00 pm on the day of the sale, then they are left at the buyers risk and no responsibility will be taken by the Vendor or the Auctioneer for the safety of the goods.
Once the goods are knocked down, they are the buyers responsibility. No responsibility will be taken by the Vendor or the Auctioneer for the safety of the goods once they have been knocked down.
Clearing Sale Rules
1. On the fall of the hammer all goods become the responsibility of the purchaser and must be paid for - no exceptions
2. No goods are to be removed from the sale unless payment has been made.
3. The highest bidder shall be the purchaser.
4. Should any dispute arise as to the bid, the relevant lot or lots, at the option of the auctioneer, may be put up again and resold.
5. Members of the public attend any auction at their own risk. No responsibility is accepted for any accident.
6. The auctioneers are merely the agents for the Vendor in respect to the sale of goods, the whole of the lots having been made available for inspection prior to the sale and no allowance or refunds will be made or shall any buyers be entitled to, in respect of any lot on the grounds that it is not correctly described in the advertising or other information supplied. The said lots are to be taken with all faults (if any) and will be at the buyers risk on the fall of the hammer.
PLANT/EQUIPMENT AND AUCTION GOODS SAFETY ADVICE TO ALL PURCHASERS
The occupational health and safety (plant) regulations 1995 and equipment (public safety) general regulations 1995 requires the following information to be supplied to buyers if it is applicable.
Important Notice:
All motorized, electrical or mechanical plant and equipment must be tested, inspected or dismantled sufficiently to consider any hazards which may be unknown. The occupational health and safety act and regulations and codes of practice require the buyers, employers and all operators of the items purchased to exercise duty of care in the supply or the use and all safe operation of plant and equipment, general goods and all other perishable items. Accordingly, before these items are used domestically or commercially, supplied or consumed, or used at any site once removed from the auction site, they must be fully operational, safe and/or fit for consumption. The purchases warrant that it is their responsibility to ensure the above.The Vendor warrants that the plant and equipment is offered free of any financial encumbrance. There may no maintenance records for any plant or equipment. Owner’s manuals for plant and equipment (if any) will be available to the purchaser.
